THE DEAL GUY GIVEAWAY Promotions Policy
The content of the website located at https://thedealguy.com (the “Site”) or otherwise made available by Matt Granite Media, Inc. and its affiliates (referred to herein individually and collectively as "Company," "we," "our," or "us") via social media sites like YouTube, Facebook and Instagram or through other online outlets (collectively, with the Site, the “Outlets”) to person(s) accessing the Outlets (“users,” "you," "your") may, from time to time, include an offer to provide goods or services, free of charge, to those visitors who visit, sign up, register, follow, recommend or “like” us on such Outlets and meet other applicable conditions, if any (each, a “Giveaway,” “Promotion” or “Give-Away Promotion”). Personal information (like a name or email address) received by us from visitors in connection with a Give-Away will be treated according to the Company’s Privacy Policy.
Each Give-Away Promotion will be subject to its “Official Rules,” a sample of which can be found here.

OFFICIAL RULES
NO PURCHASE OR CONSIDERATION OF ANY KIND IS NECESSARY TO PARTICIPATE OR WIN. A PURCHASE OR CONSIDERATION PAID WILL NOT IMPROVE YOUR CHANCES OF WINNING. MUST BE 18 YEARS OR OLDER TO ENTER OR WIN.
Void where prohibited by law.
1. Sponsor. This give-away promotion (as further described below) is sponsored by Matt Granite Media, Inc., a Canadian corporation (the “Sponsor”). Sponsor may be contacted through its counsel, Calfee, Halter & Griswold LLP, 1405 E. Sixth Street, Cleveland, Ohio 44114, c/o Dan McMullen. The promotion is not sponsored by or affiliated in any way with Facebook, YouTube, or Instagram. All those individuals entering (also “users,” “you,” “your,” “entrants”) agree to these official rules and the decisions of the Sponsor, which are final and binding. Any capitalized terms used but not defined in these Official Rules will have the meaning set forth in The Deal Guy Give-Away Promotions Policy.
2. Promotion Date and Time. The Promotion will take place on OCTOBER 28TH, 2024 and shall start at 12:00PM ET and end at 12:01AM ET on NOVEMBER 24TH (the “Promotion Period”).
3. Eligibility. The Deal Guy Black Friday Giveaway promotion (the “Promotion”) is open only to individuals who are legal residents of the United States and 18 years of age or older. Employees of Sponsor, and their respective parents, subsidiaries, agencies, and affiliated companies and their immediate families are not eligible.
VOID IN ANY JURISDICTION WHERE PARTICIPATION IS PROHIBITED. All federal, state, and local laws and regulations apply. By entering the Promotion, you represent and warrant to Sponsor that you meet these criteria. You further represent and warrant that your participation in or attempted participation in the Promotion does not violate any federal, state, or local law or regulation that governs your entry into the Promotion.
4. How to Enter. NO PURCHASE IS NECESSARY TO PARTICIPATE IN THE PROMOTION OR TO WIN A PRIZE.
To participate in the Promotion, simply go to https://thedealguy.com/p/the-deal-guy-newsletter-issue-23 (“Promotion Site”), and follow the directions in the giveaway section. You must submit all required information and follow all instructions to be eligible to enter to win a prize. Entries must be submitted between October 28th 2024 at 12:00PM ET and November 24th 2024 at 12:01AM ET. The Promotion is only open to those who have completely and correctly followed the entry instructions.
There is no limit of Promotion entries (“Entry”) per household. Sponsor reserves the right to disqualify any household that submits multiple invalid entries. All materials submitted in connection with an Entry become the property of Sponsor and will not be acknowledged or returned.
Proof of emailing or submitting the Entry form does not constitute proof of delivery or Entry. In the event of a dispute over the identity of an Entrant, the Entry will be deemed submitted by the authorized account holder of the email address associated with the entry form (the “Entrant”). An “authorized account holder” is defined as the person assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses. Every entry submission must be manually keystroked and manually entered by the Entrant. Automated and/or repetitive electronic submission of Entries (including, but not limited to, Entries made using any script, macro, bot, or sweepstakes service) will be disqualified and transmissions from any related email or IP addresses may be blocked.
Sponsor is not responsible for incomplete, lost, late, damaged, illegible, misplaced or misdirected emailed or mailed entries or faulty transmissions, technical computer hardware or software failures of any kind, lost or interrupted or unavailable network connections, or failed, incomplete, garbled, misrouted, scrambled or delayed computer transmission or other technical or user errors or problems of any kind, whether mechanical, human, electronic or otherwise, which may limit a user's ability to participate in the Promotion. Sponsor is not responsible for any typographical or other error in the printing. publication or administration of the Promotion or in the announcement or award of prizes for same. Sponsor assumes no responsibility or liability for (a) any incorrect or inaccurate Entry information; (b) any unauthorized access to, or theft, destruction or alteration of Entries in connection with this Promotion; (c) inaccessibility or unavailability of the Internet or the Promotion Site or any combination thereof; or (d) any injury or damage to any user’s or other person's computer which may be related to or resulting from any attempt to participate in the Promotion or download any materials in the Promotion.
Sponsor may, in its sole discretion, suspend or cancel the Promotion at any time prior to the award of prizes, for any reason or no reason, with or without advance notice to Entrants or other user.
(1) BY ENTERING THE PROMOTION, YOU AUTHORIZE SPONSOR TO USE THE INFORMATION YOU SUBMIT TO CONTACT YOU REGARDING SUBJECTS UNRELATED TO THE PROMOTION.
(2) SPONSOR., HOWEVER, WARRANTS THAT IT WILL NOT SELL, SHARE, OR OTHERWISE INTENTIONALLY MAKE YOUR INFORMATION AVAILABLE TO THIRD PARTIES UNAFFILIATED WITH SPONSOR.
(3) IF YOU DO NOT CONSENT TO THE USE OF YOUR PERSONAL INFORMATION FOR PURPOSES UNRELATED TO THE PROMOTION, PLEASE NOTE YOUR PREFERENCE ON YOUR ENTRY. UPON SUCH NOTICE, THE INFORMATION YOU PROVIDE WILL NOT BE USED BY SPONSOR. FOR ANY PURPOSE OTHER THAN THE PROMOTION.
4. Prizes. Prize winners will be determined through a random drawing from all eligible Entries received. The drawing will take place on November 24th, and 3 prize winners will be drawn. Prizes will be the form of retail gift cards, with a retail value of 1x $500, 1x $250 or 1x $100.
5. Winner Selection and Notification. Prize winners will be notified by email sent to the email provided in the winners’ Entry (“prize notification”). Should a prize notification or prize addressed to an Entrant be returned as undeliverable, Sponsor may, but shall have no obligation to, resend the notice (whether by the same or another method), research the Entrant’s address, or make any further attempts at delivery; Sponsor may also disqualify that Entrant and select an alternate winner.
Prize winners may be required to execute and return a Winner’s Declaration , 1099 or W-9 form (where applicable), and a publicity release (where not prohibited) within a specified period following prize notification.
If a winner refuses to timely execute and return the required forms or if a winner is unavailable or refuses to accept a prize for any reason, in Sponsor’s sole discretion an alternate winner may be chosen.
Any alternate winner will have the same rights and obligations as the original winner.
6. Expenses, Taxes, and Fees. All expenses not specifically mentioned herein are not included and are the sole responsibility of each prize winner. Prizes consist of only those items specifically listed as prizes for each Promotion and Sponsor reserves the right, in its discretion, for any reason or no reason, to substitute prizes of equal or greater value compared to those listed. Sponsor is responsible only for prize delivery and not for prize utility, quality or otherwise. Taxes and fees, if any, are the sole responsibility of prize winners. All prize winners, as a condition of winning, will be required to complete and return to Sponsor a W-9 form (where applicable) and all prizes will be reported on an IRS Form 1099 reflecting the value of each winner’s prize (where applicable).
7. Odds of Winning. The odds of winning depend on the number of valid entries received by Sponsor.
8. Releases. By entering or attempting to enter the Promotion, even if ineligible, Entrant releases, indemnifies, and holds harmless Sponsor, Facebook, Instagram, YouTube, and any advertising or promotion agencies or other parties involved with or retained to provide services in connection with the Promotion, and each of their respective owners, directors, officers, employees, agents, independent contractors, affiliates, parents or related entities, subsidiaries, or successors (collectively, the "Promotion Entities"), against any and all liability, costs (including attorneys’ fees), losses, damages (including punitive, incidental, consequential, and special damages and lost profits), claims, demands, or actions of any kind arising out of or relating to the Promotion in any way, including, without limitation, (1) Entrants’ participation or attempted participation in the Promotion; (2) any errors in evaluating the eligibility of Entrants; (3) any acceptance, possession, ownership, misuse or use of the prizes; (4) any typographical, mechanical, technical, programming, human, or other error or malfunction in the printing, offering, selection, operation, or announcement of the Promotion and/or any prize; (5) any technical malfunctions of the computer online system, computer dating mechanism, computer equipment, software, or Internet service provider utilized by Sponsor; (6) any lost/delayed data transmissions, omissions, interruptions, viruses, bugs, defects, and/or any other errors or malfunctions, even if caused by the negligence of the Promotion Entities, and (7) any failure of the Sponsor to receive a mailed Entry into the Promotion.
9. Personal Information. Entrant agrees to be bound by these Official Rules and Sponsor’s Privacy Policy. By entering the Promotion, Entrant agrees to Sponsor’s use of Entrant’s personal information as described herein and, as otherwise applicable, in Sponsor’s Privacy Policy.
10. Caution. ANY ATTEMPT BY A USER, ENTRANT OR OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY VIOLATE CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTY TO THE FULLEST EXTENT PERMITTED BY LAW.
11. Error Correction. Sponsor reserves the right to correct or change any and all printing, typographical, mechanical or technical errors. If because of a printing or other technical error, or for any other reason, more prizes are claimed than the number set forth in these Official Rules, a random drawing will be held among all eligible Entrants making apparently valid claims to award the number of prizes available up to the number set forth in these Official Rules. Only the types and numbers of prizes stated in these Official Rules are available to be won in the Promotion.
12. Winner’s List. The winners’ names and Official Rules, terms and conditions may be posted on the Sponsor’s website at http://thedealguy.com/winnerslist. A list of winners and/or the Official Rules may also be acquired by sending a request for the list or rules to this email address. Requests must be sent within four (4) weeks of the end of the Entry Period.
13. Restrictions. The Promotion is void where prohibited, taxed or otherwise restricted.
14. Dispute Resolution. Any disputes relating to the Promotion arising between Entrants or attempted Entrants and Sponsor shall be submitted to the federal, state, and local courts located in Ontario, Canada, and resolved under the laws of the State of Ontario.
15. Additional Considerations.
Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules, including by, and without limitation, in its sole discretion, disqualifying any person tampering with the entry process, the operation of any Promotion-related website, or who is otherwise in violation of these Official Rules.
Sponsor further reserves the right to cancel, terminate, or modify the Promotion without notice. In the event of cancellation, the Promotion prizes may be awarded by random drawing of the eligible Entries received prior to the date of the cancellation or not awarded at all, at Sponsor’s sole discretion.
